NY State Court Grants MBKK’s Motion for Summary Judgment

In a Decision and Order issued in September 2022, the New York County Supreme Court granted MBKK’s motion for summary judgment holding that the plaintiffs had breached their agreement with MBKK’s clients to purchase a cooperative apartment located on Manhattan’s Upper East Side. The court dismissed the buyer’s claim to recover their security deposit, and held that MBKK’s clients could retain the security deposit and also directed the plaintiffs to pay the defendants’ attorney’s fees.
