MBKK Represents Whistleblower in $2.5 Million Recovery by the United States from Public Consulting Group LLC

The United States recovered $2.5 million from Public Consulting Group LLC (“PCG”) to settle allegations in a whistleblower lawsuit in which David Koenigsberg represented the plaintiff, that PCG caused improper claims for payment to the U.S. Department of Health & Human Services, Centers for Medicare and Medicaid Services (“CMS”).  The settlement arose out of a False Claims Act qui tam whistleblower suit that alleged that the State of New Jersey hired PCG to administer a New Jersey program under which the state and local school districts could receive federal funding for providing medical services to Medicaid-eligible students.  The whistleblower’s complaint had alleged that PCG caused local school districts to submit claims to CMS for evaluation services that PCG knew or should have known were not covered by Medicaid. The whistleblower received 21% of the federal government’s recovery.
